Simplifying Compliance with New US CPSC eFiling Requirements

January 09, 2025

The consumer goods industry is reminded that the final rule to revise 16 CFR 1110 for eFiling was approved by the US Consumer Products Safety Commission (CPSC) on December 18, 2024. This revision updates the existing certificate of compliance (CoC) requirements for all CPSC-regulated products. A link to the full draft is available here

The final rule applies to all consumer product importers, domestic manufacturers and private labelers required to issue CoC for regulated products and substances imported into the US for consumption, warehousing or distribution for commerce. It incorporates revisions based on industry feedback from the supplemental notice of proposed rulemaking (SNPR) issued in December 2023 and outcomes from the beta pilot project, which concluded in June 2024.

Key updates include disclaimer message set (DMS) requirements for imported goods and clarification over definitions. Read our SafeGuardS for an overview of the key changes.

The new rule will take effect 18 months after the date of publication in the Federal Register, with a 24-month effective date for consumer products imported into a foreign trade zone (FTZ) that subsequently enter the US market for consumption or warehousing.

Simplify CPSC eFiling with SGS SMART

SGS SMART – the one-stop supply chain management platform for compliance, traceability and sustainability – now includes an integrated eFiling module. Designed to align with CPSC requirements, it automatically collects product data, ensuring accuracy and reducing the possibility of manual input errors. Certificate data can be received in one of three ways:

  • Word general certificate of conformity (GCC)/children’s product certificate (CPC) document export
  • CSV file export
  • Direct submission via API to the CPSC

SGS SMART also provides the opportunity to receive regulatory updates and allows continuous monitoring of product test data against CPSC regulations. Documentation is held in a centralized database and can be easily accessed and tailored to the individual needs of each client.

With a decision on CPSC eFiling rules now made, importers, manufacturers and private labelers operating in the US must prepare their supply chains for the new requirements. The SGS SMART CPSC eFiling module enables a seamless transition.
