The Control of Asbestos Regulations 2012, and CAR2006 before them, place very specific duties on those who own, manage or control non-domestic premises and by inference, domestic premises where work is being carried out to manage the risks arising from asbestos containing materials (ACMs).

Regulation 4 of the Control of Asbestos Regulations 2012, Duty to Manage Asbestos in Non-Domestic Premises, states that you must have a policy for asbestos management. This policy must include carrying out an assessment to identify and assess asbestos risk. If asbestos is identified, then you must have a written plan to manage ACMs and ensure that they remain in good condition. You must provide, and regularly refresh, information and training about ACMs to workers who may disturb the asbestos. Finally, you must regularly review the effectiveness of all of these measures.

If the Health and Safety Executive (HSE) finds that you do not fully comply with these requirements, you are liable for prosecution. You may receive a custodial sentence if serious deficiencies are identified.
