Turkey Strengthens Toy Safety

Turkey aligns its Toy Safety Regulation with many provisions from the European Toy Safety Directive. The requirements for chemicals will become effective on December 24, 2020.

In October 2016, Turkey published its Toy Safety Regulation (Oyuncak Güvenliği Yönetmeliği (OGY)) under Number 29847 in the Resmi Gazete. That piece of legislation is essentially based on the European Toy Safety Directive 2009/48/EC (TSD).
 
Since its publication, the OGY has been revised to include many of the amended provisions from the TSD, including the use of nickel in toys or toy components made of stainless steel and toy components intended to conduct an electric current, as well as restricting nine specific chemicals in toys intended for children under 36 months or other toys intended to be placed in the mouth.
 
On December 24, 2019, Turkey published Regulation Number 30988 to strengthen the OGY and to further align its requirements with the TSD. The latest revision contains, inter alia, several important changes:
  1. Strengthening the migration limit for chromium (VI) in category III toy materials
  2. Strengthening the migration limits for lead in all three categories of toy materials
  3. Strengthening the migration limit for bisphenol A (BPA) in toys intended for children under 36 months or other toys intended to be placed in the mouth
  4. Addition of phenol content to the same scope of toys as for BPA above
  5. Clarifying ‘aquatic toys’ are ‘water-based toys’, including hobby paints, finger paints, window/glass paints, glues and soap bubbles

There are two effective dates:

  • December 24, 2019 for provisions other than points 1 to 4 above
  • December 24, 2020 for points 1 to 4 above

Highlights of the requirements for chromium (VI) and lead, as well as BPA and phenol are summarized in Tables 1 and 2 below.
