Ukraine Specifies Declaration Requirements for Food Contact Materials and Articles

Ukraine has issued legislation approving the declaration of conformity requirements for food contact materials (FCM) and articles. The provisions will apply from November 19, 2025.

In December 2023, Ukraine’s Ministry of Agrarian Policy and Food (Міністерство аграрної політики та продовольства) published Order No. 1743 of October 2, 2023, to approve the written declaration of conformity (DoC) requirements for food contact materials  and articles (the Order).

The Order details general provisions for a DoC for 18 types of FCM, including a combination of these materials and/or recycled materials.

A DoC must accompany ceramic articles that are not yet in contact with food at all stages of circulation, including the retail stage.

Varnishes and coatings made with bisphenol A (BPA) should be accompanied by a DoC at all stages of production and circulation, except at the point of sale to end users.

To demonstrate compliance with legislative requirements, test reports and other documentation for food contact plastics, ceramics, varnishes and coatings demonstrating compliance must be provided if requested by the authorities.

The Order entered into force in December 2023 and will apply from November 19, 2025 – the same day that applies to the nation’s law on food contact materials and articles (SafeGuardS 135/22)
