What are the RED’s essential requirements?
Generally, the essential requirements to be met are:
- 3.1a Health
- 3.1a Safety (2014/35/EU shall be included)
- 3.1b EMC 2014/30/EU
- 3.2 Radio
- 3.3 Requirements for radio equipment within certain categories or classes
Presumption of conformity
Radio equipment which conforms to harmonized standards (HS) or parts thereof, the references of which have been published in the OJEU, shall be presumed to be in conformity with the essential requirements set out in Article 3 covered by those standards, or parts thereof.
Conformity assessment procedures
In relation to the requirements of RED section 3.1, the conformity procedure may be one of those set out in:
- Annex II (Internal Production Control)
- Annex III Module B and Module C (Notify Body assessment involved)
- Annex IV Module H (Notify Body assessment involved)
For the requirements of RED sections 3.2 and 3.3, there are two ways to demonstrate conformity:
- The manufacturer has applied HS which use any of the aforementioned procedures
- The manufacturer has not applied, or has applied only in part HS, or where such HS do not exist, shall use either Annex III Module B and Module C or Annex IV Module H
