The aim of the guide is to explain the general principles of EU consumer product legislation, and to contribute to a coherent application of these rules.
The latest revision of the “Blue Guide” was published in June 2022. The amendment reflects recent changes in the legislation, and in particular the adoption of a new Regulation on Market Surveillance Regulation (EU) 2019/1020.
The “Blue Guide” was first published in 2000. It provides non-binding guidance intended for better understanding of the EU’s non-food product safety requirements, the European conformity assessment system, the accreditation of laboratories, CE marking, and EU market surveillance.
The Main 2022 Changes Include:
- Placing on the market: providing examples of “own use exemptions”
- Right to repair: to reflect the EU Commission’s ambition for a broader right to repair
- Software: a new section has been inserted to introduce cybersecurity as a risk, and to classify software updates similar to physical repairs and modifications
- Declaration of Conformity (DoC): clarifying that a Declaration of Conformity continuously needs to be updated
- Fulfilment service providers: explaining the role and obligations of fulfilment service providers, and to online sales obligations as defined in Regulation (EU) 2019/1020
- Brexit: adding a section about the withdrawal of the United Kingdom from the EU and the status of Northern Ireland
