Canada is proposing to revise its Formaldehyde Emissions from Composite Wood Regulations. Comments are accepted until August 31, 2023.
On June 17, 2023, Canada initiated a 75-day consultation on its proposed revisions to the nation’s Formaldehyde Emissions from Composite Wood Regulations (SOR/2021-148, the Regulation) and the directive concerning testing for formaldehyde emissions (SafeGuardS 97/21 and 99/22).
The proposed amendment to the regulation addresses several deficiencies and will further align its requirements with changes to the United States (U.S.) Toxic Substances Control Act Title VI (TSCA Title VI). It:
- Provides a definition for ‘accredited laboratory’ – a laboratory that is accredited to:
- ISO/IEC 17025 ‘General requirements for the competence of testing and calibration laboratories’ by an accrediting body that is a signatory to the International Laboratory Accreditation (ILAC-MRA) or Environmental Quality Act, CQLR, c. Q-2; and
- Scope of accreditation includes testing for formaldehyde emissions from composite wood panels or laminated products
- Removes the accreditation requirement for laboratories conducting routine quality control formaldehyde emissions testing
- Provides clarification for regulated economic operators
- Clarifies record-keeping requirements for finished goods along the composite wood products supply chain by requiring a single manufacturer’s attestation affirming that only certified panels were incorporated into the finished good
- Minimizes international trade barriers by maintaining close alignment with U.S. TSCA Title VI
Comments will be accepted until August 31, 2023.
The amendments will become effective on the 90th day after the day on which they are issued in Canada Gazette, Part II.
