Czech Republic Repeals Legislation on Toys and Products for Young Children

The Czech Republic has repealed its decree on hygienic requirements for toys and products for children under three years of age.

In 2001, the Czech Republic published Decree of the Ministry of Health No. 84/2001 Coll. to establish hygienic requirements for toys and products for children under three years of age. This comprehensive piece of legislation, as amended by Decree No. 521/2005 Coll, contained requirements for safety and the marking of products for young children. These included restrictions for pathogenic micro-organisms, requirements to make colored and finished toy materials resistant to sweat and saliva, and requirements for AZO-dyes, phthalates, heavy metals, etc. 

In June 2023, the Czech Republic issued Act No. 167/2023 (Sbirka zakonů č. 167 / 2023, the Act) to amend several pieces of legislation, including those relating to the Public Health Protection Act. This Act, in part, repeals the aforementioned Decree Nos 84/2001 Coll. and 521/2005 Coll. on toys and products for children under the age of three (Part 1 Article III).

Per the Act, Decree Nos. 84/2001 and 521/2005 were repealed on July 1, 2023 (on the 15th day after promulgation of the Act). By repealing these decrees, the Czech Republic no longer enforces additional national requirements relating to toy safety.

It is important to note that toys destined for the Czech Republic are obliged to comply with the Czech transposition of the EU toys Directive 2009/48/EC (consolidated version to December 2022 for reference). The national Czech transposition of 2009/48/EC is to be found in: Government Regulation No. 86/2011 Coll.
