US Consumer Products Safety Commission (CPSC) has voted to incorporate by reference ANSI/UL 4200A-2023 as the safety standard for consumer products containing button cell or coin batteries
On September 11, 2023, the CPSC voted to adopt the voluntary standard ANSI/UL 4200A-2023 (Standard for Safety for Products Incorporating Button Batteries or Coin Cell Batteries) as the mandatory consumer product safety rule for consumer products containing button cell or coin batteries, to be codified at 16 CFR 1263. CPSC has determined that the recent update of ANSI/UL 4200A, published on August 30, 2023, meets the performance and labelling requirements in section 2(a) of Reese’s Law with respect to consumer products containing button cell or coin batteries.
Reese’s Law mandates the CPSC to promulgate a consumer product safety standard that would eliminate or adequately reduce the risk of injury from button or coin cell battery ingestion by children that are 6 years of age or younger during reasonably foreseeable use or misuse conditions.
ANSI/UL 4200A-2023 covers the following requirements:
- Construction requirements
- Pre-conditioning requirements
- Abuse tests
- Secureness test
- Product and packaging markings requirements
- Instructions requirements
CPSC will issue a separate final rule for button cell or coin battery packaging labeling requirements since such products are not covered under the scope of ANSI/UL 4200A-2023.
A 180 day enforcement discretion after the rule is published in the Federal Register will be provided by the CPSC according to the statement from the commissioners.
