Maine, USA, Consults Over Revised Proposal to Ban PFAS in Specific Food Packaging

The state of Maine has initiated a consultation over a revised proposal to prohibit PFAS in nine types of food packaging. Comments are accepted until November 30, 2023.

Since the approval of Maine’s LD 1433 (Chapter 277) in 2019, the state’s Department of Environmental Protection (DEP) has made available a proposal to ban nine types of food packaging that contain intentionally added per- and polyfluoroalkyl substances (PFAS) and are manufactured, in substantial part, from paper, paperboard or other materials derived from plant fibers that are intended for short-term storage or to hold freshly prepared food (SafeGuardS 99/23 and references therein).

In October 2023, the Maine DEP initiated a 38-day consultation over an updated proposal to revise Chapter 80 ‘Reduction of Toxics in Packaging’. It:

  • Prohibits the nine types of food packaging made from plant fibers that contain intentionally added PFAS under a new section 5, as detailed above
  • Exempts manufacturers with less than USD 1 billion in total annual sales of food or beverage products that are contained in a food package from the prohibition on phthalates and/or PFAS in these products.

Comments will be accepted until November 30, 2023
