Moldova has revised its legislation on toy safety to further align with EU regulations. The revisions became effective in October 2023.
In 2015, Moldova announced Decision No. 808/2015 approving the Technical Regulation on the Safety of Toys (the Technical Regulation). Since its publication, the nation has published the list of standards for presumption of conformity with the Technical Regulation (SafeGuardS 70/18 and 125/22)
In September 2023, Moldova issued Decision No. 622 of August 30, 2023 (Decision No. 622/2023) to revise the Technical Regulation by transposing several provisions from Directive 2009/48/EC on toy safety, as last amended by Directive (EU) 2021/903 regarding specific limit values for aniline in certain toys, in the European Union (EU, consolidated version to December 2022). This latest amendment further aligns the Technical Regulation on toy safety with those in the EU.
Decision No. 622/2023 contains several important changes when compared to Decision No. 808/2015. It:
- Clarifies that the presence of the CE mark on the toy excludes the need for the SM mark on the same toy
- Updates the two lists of allergenic fragrances (Annex 2, Tables 1 and 2)
- Strengthens the three sets of migration limits for each of aluminum and lead (Annex 2, Table 3)
- Expands the number of substances with specific limit values from four to 12 for toys intended for children under 36 months or in other toys intended to be placed in the mouth (Table to Annex 2, Chapter VI, Part B):
- Eight new entries
- Formamide
- 1,2-benzisothiazol-3(2H)-one
- 3 to 1 mixture of 5-chloro-2- methyl-4-isothiazolin-3-one (CMIT) and 2-methyl-2H -isothiazol-3-one (MIT)
- CMIT
- MIT
- Phenol
- Formaldehyde
- Aniline
