The US federal government has introduced a proposal to regulate executive agencies from procuring specific products that contain PFOA or PFOS and to prioritize the purchasing of products that do not contain PFAS.
In July 2023, the U.S. Senate introduced S.2283 ‘PFAS-Free Procurement Act of 2023’ to prohibit executive agencies, defined under §133 to Title 41 of the United States Code, from entering into a new contract for the procurement of certain products containing perfluorooctanoic acid (PFOA) or perfluorooctane sulfonate (PFOS).
The proposed Act also directs the head of an executive agency to prioritize the procurement of these products that do not contain any per- or polyfluoroalkyl substances (PFAS) at all.
Highlights of the proposal reported to the Senate in November 2023 in relation to PFOA and PFOS in specified products are summarized in Table 1.
