In December 2023 the EU Commission published a revised version of guidance document number 7 on the classification of toys intended to be used in or on the water.
The EU Commission publishes and revises guidance documents to help on the classification deciding if a product is a toy or not. This time the guidance on toys intended to be used in or on the water has been revised. Some of the changes include:
- Providing additional information regarding inflatable bath toys with the inclusion of examples of toys intended to bear the weight of a child and not
- Clarification that fish rings intended to be thrown to the bottom of a mini or small pool for a child to pick up while sitting are toys. This separates them from diving sticks with no play value intended for dive practice
- Clarification of products that are not toys:
- Examples of inflatable floating leisure articles larger than 1.20 m:
- Tubes
- With child-appealing design (candy, watermelons)
- Animal patterns (cat faces) or animal shapes (swans, unicorns, etc.)
- Mattresses
- Swimming aids
- Snorkeling masks
- Diving rings and other diving products
- Baby floats, baby lying rings and baby neck-rings
- Water walking balls
