The US Consumer Product Safety Commission (CPSC) has opened a public consultation over a proposed rulemaking for electric bicycles (e-bikes) to enhance safety and reduce the risk of injury.
The CPSC is responsible for regulating bicycles under the Federal Hazardous Substances Act (FHSA) and has extended regulations to include low-speed e-bikes. E-bikes are bicycles with electric motors that can be partially or fully powered by electricity. Between 2017 and 2022, an estimated 53,100 emergency department-treated injuries were associated with e-bikes. The CPSC is concerned about the risk of injury or death associated with the use of e-bikes and is seeking to address this through regulatory measures.
The CPSC follows a process that starts with an advanced notice of proposed rulemaking (ANPR), which identifies the article or substance to be regulated and the nature of the risk of injury. The ANPR also summarizes regulatory alternatives and existing standards and invites public comments or suggested standards. After considering the comments received, the CPSC may issue a proposed rule under the FHSA, followed by a final rule.
The proposed rulemaking focuses on e-bikes and does not include gas-powered bicycles, non-powered bicycles, or battery-powered ride-on toys subject to mandatory toy standard requirements. In regard to the public consultation, the CPSC has prepared 52 questions covering technical, regulation and market perspectives.
The proposed rulemaking by the CPSC aims to enhance safety and reduce the risk of injury associated with e-bikes. By considering potential performance requirements, technologies and market information, the CPSC seeks to develop regulations that ensure the safe use of e-bikes while promoting their benefits as a mode of transportation. Public input and feedback are crucial in shaping these regulations to effectively address the risks associated with e-bikes.
