UK Revises GB Mandatory Classification and Labeling List for Substances and Mixtures

The United Kingdom’s Health and Safety Executive (HSE) has amended the Great Britain mandatory classification and labeling list (GB MCL list) for substances and mixtures. The revision applied from June 26, 2024.

In June 2024, the HSE of the United Kingdom (UK) Government issued a consolidated Ministerial Decision for the inclusion of 88 substances from the 14th and 15th Adaptations to Technical Progress (ATP) to European Regulation (EC) No 1272/2008 on classification, labeling and packaging of substances and mixtures (ATP 14 and 15 to the CLP Regulation).

According to the HSE website, 90 substances in ATP 14 and 15 to the EU CLP Regulation that were included in the GB MCL list were not retained under GB law at the end of the implementation period on December 31, 2020. By using Article 37 and Article 37A procedures of the GB CLP Regulation, the HSE revised the GB MCL list to give legal effect to the GB MCL for 88 substances and removed entries for titanium dioxide (in powder form) and granulated copper.

The HSE has identified additional information for titanium dioxide (in powder form) and granulated copper where further evaluation is required under Article 37A of the GB CLP Regulation. Duty holders impacted by the declassification of these two substances should self-classify in line with the GB CLP Regulation.

A timeline has not been agreed for Article 37A assessment of titanium dioxide (in powder form) and granulated copper. Stakeholders will be alerted when the HSE’s GB MCL proposals for these two substances are published on the agency’s website.
