Ukraine has issued the nation’s EU REACH-like regulation for the management of chemicals. The new law will enter into force on January 26, 2025.
On July 26, 2024, the Cabinet of Ministers of Ukraine (Кабінет Міністрів України) published Resolution No. 847 of July 23, 2024, (Resolution No. 847/2024) ‘On approval of the Technical Regulation on the Safety of Chemical Products’ (Ukraine REACH), in the nation’s official gazette. The full text of this technical regulation can be accessed on Ukraine’s Ministry of Environmental Protection and Natural Resources website.
This technical regulation, modeled on Regulation (EC) No. 1907/2006 ‘Registration, Evaluation, Authorization and Restriction of Chemicals (REACH, consolidated version to June 2024 for reference) in the EU, is a comprehensive piece of legislation for the management of chemicals that aims to provide a high level of protection to human health and the environment. It:
- Details the registration requirements and deadlines for chemicals, whether on their own, in mixtures or in articles, if they meet certain criteria and threshold levels (no data, no market)
- Sets forth the information required to support substance registration (tonnage dependent)
- Specifies the criteria for notification of substances of very high concern (SVHC) in articles. Notification applies six months after the SVHC has been added to the (Candidate) list
- Allows a simplified substance registration procedure for manufacturers, importers and authorized representatives (only representatives, OR) of non-Ukrainian origin who fulfilled the requirements for the registration of such substances under EU REACH
- Describes the requirements for a safety data sheet (SDS)
- Indicates the obligation upon suppliers of an article to communicate information on SVHC to recipients of the article and consumers (Article 185, cf. Article 33 of EU REACH)
- Details the 59 SVHC on the authorization list with their latest application and sunset dates (Annex XIV)
- Details a list of chemicals and their scope of restriction (Annex XVII), consistent with Annex XVII of EU REACH. Ukraine may in future adopt Regulation (EU) 2024/1328 in relation to octamethylcyclotetrasiloxane (D4), decamethylcyclopentasiloxane (D5) and dodecamethylcyclohexasiloxane (D6) to further align its entry 70 with those under EU REACH
Resolution No. 847/2024 will become effective on January 26, 2025 – six months after the date of its publication.
