The EU has made three changes to its list of the standards for presumption of conformity with the Toy Safety Directive. The latest list of toy safety standards became effective on May 31, 2021.
On May 31, 2021, the European Union (EU) published Implementation Decision (EU) 2021/867 with the latest list of toy safety standards for presumption of conformity with Directive 2009/48/EC (Toy Safety Directive, TSD – consolidated version to May 2021). This latest set of standards contain, inter alia, several important provisions:
Finger paints
- Inclusion of EN 71-7:2014+A3:2020 (SafeGuardS 70/20) with a six-month transitional period. EN 71-7: 2014 + A2:2018 may not be used after November 28, 2021
N-nitrosamines and N-nitrosatable substances
- Inclusion of EN 71-12:2016 for N-nitrosamines and N-nitrosatable substances – this standard contains a completely new set of four toy categories and their limit values for N-nitrosamines and N-nitrosatable substances in elastomers, including more stringent migration limits for N-nitrosamines and N-Nitrosatable substances from elastomeric materials in toys intended for use by children under 36 months and intended or likely to be placed into the mouth when compared to the migration limits in the TSD. There is a six-month transitional period for this standard and EN 71-12: 2013 may not be used after November 28, 2021
Electric toys
- Replacing a set of eight standards with EN IEC 62115:2020 and EN IEC 62115:2020/A11:2020, the two latest standards for electric toy safety (SafeGuardS 31/20). The electric toy safety standards have a nine-month transitional period until February 21, 2022.
The latest Implementing Decision repeals Implementing Decision (EU) 2019/1728.
This latest set of toy safety standards became effective on May 31, 2021 – the day of its publication in the Official Journal of the European Union (OJEU).
