As required by Reese’s Law, the CPSC has published in the Federal Register a direct final rule for button cell or coin batteries and consumer products containing such batteries
On September 21, 2023, the CPSC published a direct final rule (16 CFR 1263) establishing a safety standard for button cell or coin batteries and consumer products containing such batteries, aimed at eliminating or adequately reducing the risk of injury or death caused by ingestion of these batteries by children aged six years old or younger. The rule incorporates ANSI/UL 4200A-2023 (Standard for Safety for Products Incorporating Button Batteries or Coin Cell Batteries).
The direct final rule will become effective on October 23, 2023, provided the CPSC does not receive significant adverse comments by October 5, 2023. The CPSC has recognized the limited testing availability and therefore has provided a 180-day transitional period of enforcement discretion from September 21, 2023, through to March 19, 2024.
A final rule was also published on September 21, 2023, establishing labeling requirements for button cell or coin battery packages since such products are not covered under the scope of ANSI/UL 4200A-2023. This final rule is effective September 21, 2024.
